Terms of Use

1. Purpose

These Terms of Use (hereinafter "Terms") govern access to and use of the echomusic.ch platform (hereinafter "the Platform"), operated by David Divorne from Lausanne, Switzerland.

By creating an account on echomusic.ch, the user accepts these Terms without reservation.

2. Description of Service

echomusic.ch is a community platform dedicated to the Swiss music scene. It enables musicians, formations, organisers, and music enthusiasts to:

Create a public artist profile (Onstage account)
Publish and manage music classifieds (Onstage and Backstage accounts)
Discover other musicians and formations via the Matchboard
Publish events (concerts, jams, festivals)
Manage a discography and news
Contact other members through the platform

3. Account Types

Onstage Account (member)

For active musicians and formations. Allows creating a public profile, events, discography, and access to the Matchboard. Registration is subject to approval by the echomusic team.

Backstage Account (user)

Simplified account for publishing and managing music classifieds. No approval required. Can be upgraded to Onstage at any time.

4. Registration and Account

The user must provide accurate information during registration.
Each person may hold only one account.
The user is responsible for the confidentiality of their login credentials.
Onstage accounts may be refused if the profile does not match the musical purpose of the platform.

5. Content Published by Members

Members are solely responsible for the content they publish (texts, photos, information). By publishing on echomusic.ch, the member:

Guarantees they hold the necessary rights to the published content
Grants echomusic.ch a non-exclusive, free licence for display on the platform
Agrees not to publish any unlawful, defamatory, discriminatory content or content that infringes third-party rights

echomusic.ch reserves the right to remove any content that violates these Terms, without prior notice.

6. Classifieds (The Depot)

Classifieds must relate exclusively to the music field (instruments, rehearsal spaces, music gear).
Classifieds automatically expire after 30 days.
The user may mark a classified as concluded at any time.
Fraudulent or off-topic classifieds will be removed and may result in account suspension.

7. Conduct

The user agrees to:

Use the platform respectfully and in accordance with its purpose
Not send unsolicited messages (spam)
Not impersonate another member or artist
Not attempt to circumvent the website's security measures

In case of violation, echomusic.ch reserves the right to suspend or delete the account, temporarily or permanently.

8. Headliner Pass

The Headliner Pass is an optional subscription providing access to additional features (detailed statistics, management tools). Rates and specific conditions are indicated at the time of subscription.

9. Free of Charge

Basic use of the platform (profile, classifieds, events, matchboard) is free of charge. echomusic.ch reserves the right to introduce paid services in the future, which will always be clearly identified.

10. Account Deletion

The user may delete their account at any time from their account settings. Deletion results in the removal of all personal data in accordance with our privacy policy.

11. Limitation of Liability

echomusic.ch is provided "as is". We do not guarantee continuous availability of the service. echomusic.ch cannot be held liable for:

Interactions between members (transactions, musical collaborations)
Loss of data due to technical failure
Content published by members

12. Changes to Terms

echomusic.ch reserves the right to modify these Terms. Users will be informed of significant changes. Continued use of the platform after modification constitutes acceptance of the new terms.

13. Applicable Law and Jurisdiction

These Terms are governed by Swiss law. Any dispute shall be submitted to the competent courts of Lausanne, Switzerland.
